Global Business Solutions has again been engaged by Merchants (a subsidiary of the multi-national Dimension Data Group) to facilitate the transfer of over 100 employees from TransUnion. This project follows on the successful transfer of 200 plus employees from Cell C to Merchants during 2010. Global Business Solutions has developed niche expertise and experience in dealing with large scale employee transfers arising from mergers and sales of a (whole or part of a) business or operation. In such instances section 197 of the Labour Relations Act applies. Section 197 requires, inter alia, that the new employer is automatically substituted in the place of the old employer in respect of all contracts of employment, that all rights and obligations between the old employer and an employee continue in force with the new employer and that the transfer does not interrupt an employee’s continuity of employment.
