A maintenance fitter refused to perform maintenance work during the annual shutdown unless the employer paid him more than his normal rate of pay. He was dismissed for refusing to obey a lawful instruction. The commissioner found that compelling employees to work during the annual shut down breached the provisions of both the BCEA and the Main Agreement of the Bargaining Council.
