In the recent past there has been a flurry of activity what with the revision to the Codes and the issue of sector codes and notices etc.  All in all it left a lot of people “punch drunk” to the point where it was quite an amusing situation.  Be this flurry a result of a political positioning or not, the changes proposed and codes gazetted point to only one thing…BEE is going to be around for a while longer and complying will get more difficult.

The DTI believe change is needed because they have determined, whether correctly or not, that transformation is too slow.  In some instances they may have a point but all in all, we believe their approach is off the mark.  What we agree on is that all relevant legislation should be consistent with the other to ensure a consistent approach to implementation.   The discussion regarding “trumping clauses” is a worry.  Trumping, as a legislative requirement is never really required if the relevant pieces of legislation are all trying to achieve the same goal.  This current talk about BEE becoming a trumping law is therefore misplaced and probably going to be misused if legislation such as The Skills Development and Employment Equity Acts are revised without alignment to BEE.  It would leave too much room for punitive measures to be instituted based on non compliance with related legislation and seems that someone somewhere has thought up of a manner in which to create a single method of punishment for non compliance with many different requirements.  Actually at this stage all a bit of a mess.
