Commission for Employment Equity – Annual Report

The Commission for Employment Equity (CEE) annual report for the 2016 – 2017 financial year was released earlier this month.
For B-BBEE purposes, this report is of interest as it is our source of Economically Active Population, or EAP, statistics.

AIS Claims and B-BBEE certificates

The Automotive Incentive Scheme Interpretation Note 01/2015 was issued on 04 December 2015. This interpretation required compliant B-BBEE certificates to be submitted with claims for the AIS. An exemption was made whereby applicants who are non-compliant may submit a plan on how they intend to become compliant by March 2017.

This has led to the following:

  • Some applicants have had payments delayed as they have not had valid compliant B-BBEE certificates; or
  • The approval of an application being withdrawn if a claim was forfeited due to non-compliance with the B-BBEE requirements.

NAACAM (The Authority of the South African Automotive Components Industry) requested the dti for an extension of time for manufacturers to become compliant. An extension to 30 September 2017 has been granted by the dti. Compliant B-BBEE certificates must be submitted by no later than 31 October 2017 to prevent forfeiture of claims payments.

If the certificate is not received by 31 October 2017 all claims on hand or received by 31 October 2017 will be forfeited. All subsequent claims must include a compliant B-BBEE certificate. If the claim submitted after 01 November 2017 is a third and final claim then the approval will be cancelled.

These concessions will only apply to existing claims and not to new applications for AIS benefits (relevant documents can be downloaded here, here and here).
