Promulgation of remaining sections of Labour Laws Amendment Act (LLAA) – UI Act 2001

The President has promulgated the remaining sections of the LLAA as from 1 April 2020 which means that sections 7, 8(b)(dA),12,13,14,15 and 16 of the said Act shall come into operation.

Although employees already had access to up to 10 weeks’ adoption and commissioning parental leave since 1 January 2020 under the Basic Conditions of Employment Act, the actual claiming of the associated UIF benefits are available to be accessed from 1 April 2020 now that the UIF systems and processes have been put in place.

It is important to remember that where the partners in an adoption or commissioning parental context are both employees, only one partner will be able to access the 10 weeks whilst the other will qualify for the 10 days parental leave.

Increase in the COIDA maximum amount of earnings on which the employer assessment will be calculated

The Minister of Employment and Labour has prescribed the amount of R484 200.00 per annum as the maximum amount on which an assessment of an employer shall be calculated on with effect 01 March 2020.

The Minister, in addition to the above, issued a notice of  intention to amend Schedule 4 of the COID Act which deals with compensation for accidents that occur, and occupational diseases diagnosed. The proposal is to increase all to earnings benefits with 5.6% and expenses benefits with 4.6% as from 1 April 2020.
