The Union sought right of access to the Employer’s production facility in East London.

At the time, the Union had 189 members of the 2 384 employees in the factory, the majority of whom were members of NUMSA. The Union contended that its members were all monthly paid and fell within salary bands 5 and 6, which it contended should be regarded as a separate bargaining unit, of which its members constituted about one third of employees.
