This recent CCMA case dealt with what is termed residual misconduct. The employee in this instance was dismissed for not identifying a colleague who stole an item from a locker room.

 

Zide / G4S Aviation (Pty) Ltd [2012] 12 BALR 1305 (CCMA)

Parties in this matter entered into a contract of employment. The employer offered employment on condition that the employee satisfies certain security checks.
