These slides contain essential learning points for each case discussed during the seminar. We will unpack 40 of these most important cases. South Africa's labour law landscape continues to evolve at a rapid pace, presenting both challenges and opportunities for employers and employees alike. As Court interpretations refine existing statutes and new regulations emerge, organizations must stay vigilant to ensure compliance and foster positive workplace relations. The Annual Law Update (ALLU) is your essential guide to navigating this complex terrain. Led by Jonathan Goldberg, Chairman of Global Business Solutions and one of South Africa's foremost authorities on labour law, ALLU provides unparalleled insights into the latest legal developments. With his experience as Labour Market Chamber Convenor at NEDLAC and Ministerial appointment to the National Minimum Wage Commission, Jonathan offers a unique perspective on the forces shaping South African labour policy. Don't get caught off guard by shifting regulations or precedent-setting rulings. Join over 1000 of your peers at ALLU to get ahead of the curve and equip your organization with the knowledge needed to thrive in today's dynamic labour environment. Key Topics: IMPORTANT: In addition to the many Labour Appeal and Labour Court judgements, the impact of the vast amendments to labour laws that have been under negotiation at NEDLAC over the past 2 years will be an additional core focus area - this will include the coming amendments to the NMW Act, BCEA, LRA and the Employment Equity Act. South African Labour Law Update: Key Developments Restraint of Trade: Courts are strictly enforcing non-compete agreements that protect legitimate business interests, while dismissing overly broad clauses. Religious Discrimination: Employers must reasonably accommodate religious observances, as seen in a ruling favouring a marketing manager dismissed for refusing to work on the Sabbath. Workplace Assessment Practices: Psychometric testing for promotions upheld as valid when within policy guidelines and fairly administered. Operational Retrenchments: Courts remain strict on consultation requirements and objective selection criteria, even when business necessity is clear. Confidentiality Breaches: Employees reinstated after courts determined shared emails were not actually confidential, highlighting proportionality in discipline. Strike-Related Misconduct: Violent strike action has lost legal protection, with courts granting interdicts against participants in destructive industrial action. Jurisdictional Boundaries: Clarification on when disputes must go through CCMA conciliation before court proceedings, particularly for severance claims. Union Rights: Supreme Court reinforces union communication rights and protection from employer interference. Settlement Enforcement: Employers face contempt charges for non-compliance with settlement agreements, with courts taking avoidance of legal service seriously. Evidence Standards: Dismissal rulings overturned where arbitrators improperly relied on hearsay evidence, reinforcing fair hearing requirements. Retirement Age Disputes: Constitutional Court clarification on when dismissals based on age constitute discrimination. Workplace Bullying: New precedents requiring employers to take proactive measures against harassment and toxic work environments. #ALLU2025 is your comprehensive resource for understanding the current labour law landscape, equipping you with the knowledge to navigate and adapt to ongoing changes effectively. Don't miss this opportunity to stay ahead in South Africa's dynamic labour environment. KZN Employment Equity Reporting 2026: Sector Targets, DG Reviews & Compliance Thursday, 08 October 2026 | Live, Westville Country Club KZN R650.00 (excl. VAT) From Plan to Proof: Getting Sector Target Y1 Reporting Right, First Time The 2026 Employment Equity reporting cycle marks a major shift for designated employers. For the first time, organisations will need to show how actual workforce progress measures up against their five-year Employment Equity Plans and published sector targets. This practical KwaZulu-Natal Employment Equity briefing will help you complete a meaningful barriers analysis, prepare the documentary evidence expected during a DG Review, understand plan-versus-actual reporting on the new EE portal, and manage justified deviations correctly. Date: 8 October 2026 | Time: 08:00 for 08:30–12:00 | Venue: Westville Country Club | Investment: R650 per person | Presented by: Natalie Singer and Gavin Stone Great news, registrations are OPEN! Register Now Time & Location 08 October 2026, Thursday, 08:00 for 08:30 to 12:00 Live: Westville Country Club, Durban, KZN.. About The Event From Plan to Proof: Getting Sector Target Y1 Reporting Right, First Time For designated employers, the 2026 Employment Equity reporting cycle is different from the last one . The 2025/26 cycle largely established the baseline: organisations filed an Employment Equity Plan and workforce profile, but progress was not yet measured against that plan. From 1 September 2026 , the Department of Employment and Labour begins assessing designated employers against the five-year plans developed to meet published sector targets. That means employers now need to demonstrate more than intention. Any gap between the plan and actual progress will need a justifiable reason supported by evidence . From Plan to Proof: Getting Sector Target Y1 Reporting Right, First Time is a practical, in-person Employment Equity workshop for KwaZulu-Natal employers who want to approach Year 1 sector target reporting with a clear understanding of what needs to be reported, what evidence must be retained and how to prepare for increased regulatory scrutiny. Led by GBS KwaZulu-Natal consultants Natalie Singer and Gavin Stone , the session focuses on the practical work behind compliant reporting rather than simply reviewing legislation. What you’ll walk away knowing How to complete a barriers analysis that goes beyond a tick-box exercise and links directly to meaningful affirmative action measures. What documentary evidence a DG reviewer may ask to see, and how to build that evidence before it is needed. How to work with the new Employment Equity portal , including plan-versus-actual variance flags and how to assign a justifiable reason that genuinely fits the circumstances. How to respond where the organisation has undergone a material change , such as restructuring, a merger or a significant change in headcount, after the five-year plan was approved. What a Director-General Review can look like in practice, supported by a dedicated Q&A with consultants who have assisted employers through these reviews. Why getting Year 1 reporting right matters A compliant Employment Equity Plan on paper is no longer enough. Employers need to be able to demonstrate progress, explain deviations and prove that their decisions are supported by appropriate analysis and records. The brochure highlights several consequences of getting this wrong, including difficulty obtaining an EE Compliance Certificate , financial penalties for non-compliance and increased exposure during DG Reviews. For organisations that tender for or conduct business with the state, the compliance certificate is particularly important. The session therefore focuses not only on submitting the required information, but on building the supporting evidence needed to defend the organisation’s position if it is reviewed. Every attendee also receives Delegates receive 12 months of complimentary access to the GBS EE Navigator , including core Employment Equity analysis, the Compliance Checklist, DEEVIATE justifiable-reason recorder and Resources Library. Attendees also receive the Y1 EE Reporting Compliance Playbook , a practical set of checklists covering the key requirements discussed during the session, together with the option to book a free one-hour consultation with Natalie or Gavin after the event to work through their organisation’s Employment Equity Plan, barriers analysis or evidence gaps. Who should attend? This workshop is relevant to designated employers and the people responsible for Employment Equity planning, implementation and reporting, including HR and Employment Equity Managers, EE Committee members, Transformation and Compliance professionals, senior managers responsible for EE implementation, and business leaders who need confidence that their organisation is ready for Year 1 reporting and possible DG Review scrutiny.
