Injury on the Staircase: High Court Clarifies Scope of Workplace Accidents under COIDA
Does COIDA cover an employee who is injured while leaving the workplace? In Bent v Rand Mutual Assurance, the High Court found that an employee who fractured her ankle on an internal workplace staircase after finishing work was entitled to compensation. The judgment explains what “arising out of and in the course of employment” means under COIDA and when injuries sustained while entering or leaving workplace premises may qualify as compensable accidents.
