New CCMA Rules in Force: Delay is No Longer a Strategy

Global Business Solutions urges employers and stakeholders to prepare now

The revised CCMA Rules took effect on 23 October 2026 (Government Gazette 55620, Notice 4208 of 2026). They change how disputes are referred, prepared, heard and enforced, and they leave little room for employers who are unprepared.

What changes in practice?

  • Digital by default: notices may arrive by WhatsApp or SMS, documents can be filed online at any time, and hearings may be held online.

  • Fixed dates: there is no right to postponement, and con-arb can proceed to arbitration the same day.

  • Technology governance: parties carry POPIA duties, and the use of AI must be addressed at pre-arbitration conferences.

  • Real costs: procedurally unfair dismissals attract an arbitration fee, and certified awards are enforced by the Sheriff.

"The CCMA's message is clear: preparation now decides outcomes," said John Botha, Joint CEO of GBS. "Employers who are organised before a dispute arrives will avoid default awards and costs. Those who are not will pay for it."

Call to action

  • Employers: route CCMA notices to a monitored inbox and phone, count deadlines in calendar days, and treat every hearing date as fixed.

  • HR and IR teams: build in-house capability to present cases, and tighten disciplinary procedure.

  • Unions and representatives: prepare for compulsory pre-arbitration conferences and agree how AI material is used.

  • Boards and executives: confirm your business can meet a 14-day rescission window and a 21-day arbitration timeline.
